Terms of Service

1. Agreement and scope

These Terms of Service ("Terms") are an agreement between you and Trouvaillesys, a sole proprietorship registered in India, for use of the DocuChat product and brand ("DocuChat" or the "Service"). These Terms govern the authenticated web application, the public API, and customer use of DocuChat's widget and embed tools. They do not make a website visitor who merely uses a customer's embedded chatbot the contracting customer.

As an account holder or customer, you accept these Terms by signing up for, signing in to, accessing, or using the Service, including through an API key. Some signup flows also present an express Terms and Privacy checkbox. If you do not agree, do not create an account, sign in, or use the Service.

2. Eligibility and authority

DocuChat is available to individual consumers and businesses or professionals who are at least 18 years old. If you use the Service for an organization, you represent that you have authority to accept these Terms for that organization.

DocuChat is intended to be available globally, but only where its offer and use are lawful. We may refuse, limit, or discontinue availability in a country or for a person where sanctions, export controls, local law, provider restrictions, or other binding requirements prohibit or materially constrain the Service.

3. Accounts and security

You must provide accurate account information, keep account credentials and API keys secure, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account except to the extent applicable law provides otherwise. API keys act with the authority assigned to the member who created them and may be displayed only once; you must store and rotate them carefully.

4. Trial

An eligible trial lasts for up to 14 days or 20 answered messages, whichever occurs first. Trial availability, limits, and abuse controls may change prospectively. When a trial ends without a purchase, answering and account functionality may be restricted or deactivated as described in the Cancellation Policy.

5. Prepaid credits, pricing, and taxes

DocuChat uses prepaid, account-bound credits rather than a recurring subscription at launch.

• Credits are non-transferable, non-resellable, and not redeemable for cash, except for refunds expressly required by the Refund Policy or applicable law.
• Purchased credits do not expire under the current policy. This does not create a cash wallet, stored-value instrument, or guarantee that the Service will remain available indefinitely.
• At this document's effective date, standard pricing is INR 1 per credit before tax, with a minimum top-up of INR 200 before tax.
• Usage is charged according to the rate table presented for the selected model or feature. We may change prices and usage rates prospectively after notice appropriate to the change; a rate change does not retroactively change credits already granted to an account.
• Trouvaillesys is GST-registered. The current GST rate applied to standard top-ups is 18%, so a 200-credit top-up currently totals INR 236. The applicable tax, place-of-supply treatment, invoice fields, and any later rate change depend on law and transaction facts.
• Where applicable, a tax invoice identifies Trouvaillesys and GSTIN 36CSZPS8406B1Z6. A business customer may provide a valid GSTIN and billing details for legally applicable invoice treatment.

6. Customer Content

"Customer Content" means files, text, URLs and source material, chatbot configurations, instructions, prompts, conversations, and other material submitted through or for the Service.

You retain rights you hold in Customer Content. You represent and warrant that you have all rights, permissions, notices, consents, and lawful authority needed to submit and use Customer Content and to allow DocuChat to process it.

You grant Trouvaillesys a non-exclusive, worldwide, royalty-free licence to host, copy, transmit, index, retrieve, transform, display, and otherwise process Customer Content, and to permit service providers to do so, only as reasonably needed to operate, secure, support, and comply with law for the Service. This licence ends after deletion to the extent technically and legally possible, but copies or records may remain during staged cleanup, in provider or backup copies, under legal holds, or where records must be retained by law.

DocuChat's policy is not to use Customer Content to train or improve DocuChat or general-purpose AI models. Customer Content may still be sent to the selected model and service providers to deliver requested functionality. Because third-party handling depends on their current contracts, settings, retention, and terms, we do not give an absolute no-training assurance for every third-party system.

7. Generated output

To the fullest extent DocuChat can grant rights in an answer or other generated output, DocuChat grants those rights to the customer who requested it, subject to applicable law and third-party rights. Output may not be original, copyrightable, unique, accurate, complete, or non-infringing. Similar output may be generated for others.

8. Sensitive and high-stakes use

You may submit sensitive material only when you have lawful authority and can meet all applicable notice, consent, security, sector, and provider requirements. Minimize sensitive material and apply safeguards appropriate to your use.

DocuChat is not designed or certified as a credential vault or as a PCI card-data environment. Do not rely on it as primary storage for passwords, authentication secrets, private keys, or full payment-card details. If you submit such material, you assume the associated risks and remain responsible for legal, contractual, security, and PCI obligations.

High-stakes use is permitted only with independent review by appropriately qualified people. DocuChat output is not professional, legal, medical, financial, safety, employment, credit, insurance, or other regulated advice and must not be the sole basis for a decision affecting a person's rights, health, safety, finances, or access to essential opportunities. You are responsible for human review and all decisions made using output.

9. Acceptable use and investigations

You must not use the Service to violate law or rights; distribute malware or spam; facilitate fraud, exploitation, harassment, or abuse; gain unauthorized access; evade limits or metering; disrupt the Service; reverse engineer where prohibited; or submit content you have no right to use.

We may investigate credible copyright, privacy, abuse, security, payment, or legal complaints. During an investigation, we may temporarily disable specific Customer Content, chatbots, API access, embeds, or account functions. We may remove content or restrict use where reasonably necessary to address a confirmed violation or legal requirement.

10. Public API

The current public API version supports the documented operations available at the time of use. A version label, including /v1, is not a promise that an API or behavior will remain unchanged permanently. We will give reasonable advance notice of breaking changes when practical. Immediate changes may be made for security, abuse prevention, provider failure, service integrity, or legal requirements. API availability, limits, and errors are provided without a service-level commitment.

11. Widgets and embeds

The customer who embeds DocuChat controls the surrounding website and remains responsible for visitor-facing notices, lawful basis or consent where required, source and chatbot content, configuration choices, and use of chatbot responses. These responsibilities do not shift duties that applicable law places directly and unavoidably on Trouvaillesys. Additional browser-storage details are in the Cookie Policy.

12. Privacy and confidentiality

Our handling of personal data is described in the Privacy Policy. These Terms do not create a separate or broader contractual confidentiality promise. DocuChat does not offer a separate confidentiality undertaking or data processing agreement at launch. Do not submit material that requires either arrangement.

13. Availability and third-party services

The Service depends on third-party cloud, database, payment, email, security, and model providers. To the fullest extent permitted by law, DocuChat is provided as is and as available, without warranties of accuracy, completeness, non-infringement, uninterrupted availability, merchantability, or fitness for a particular purpose. We do not offer an uptime, support, disaster-recovery, RPO, RTO, or other service-level agreement under these Terms.

We may add, change, suspend, or discontinue features. We do not promise that every provider, model, integration, API version, or feature will remain available.

14. Suspension, termination, and cancellation

For a non-emergency breach, we will normally give notice and a reasonable opportunity to cure before suspending or terminating affected use. We may act immediately for serious abuse or unlawful activity, security threats, payment reversal, provider failure, imminent harm, or a legal requirement.

Termination for serious abuse, unlawful activity, or security threats leaves unused credits non-refundable except where applicable law requires otherwise. Cancellation, deactivation, staged deletion, reactivation, and permanent business discontinuation are addressed in the Cancellation Policy. Refund exceptions are addressed in the Refund Policy.

15. Limitation of liability

Nothing in these Terms excludes or limits liability, remedies, or rights that cannot lawfully be excluded or limited.

To the fullest extent permitted by law, Trouvaillesys will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for lost profits, revenue, business, goodwill, anticipated savings, or data. To the fullest extent permitted by law, Trouvaillesys's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the amounts the customer paid to Trouvaillesys for DocuChat during the 12 months immediately preceding the event giving rise to the claim.

16. Changes to these Terms

We may update these Terms. For a material change, we will email the registered account address and provide any advance period required by applicable law. The notice will identify the effective date. Continued use after that date constitutes acceptance, unless law requires express re-consent or another process. Non-material clarifications may take effect when posted.

17. Governing law and disputes

These Terms are governed by the laws of India. Subject to mandatory consumer rights and any forum or remedy that cannot be waived, courts in Hyderabad, Telangana are the preferred forum for disputes. Nothing in this section removes rights available under mandatory law in your place of residence or use.
